PLEASE READ THIS SUPERBEAST PRODUCT LIABILITY WAIVER VERY CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND MAY LIMIT YOUR ABILITY TO MAKE FUTURE CLAIMS.
THE PURCHASER OR RIDER (“YOU”), OR YOUR PARENT/LEGAL GUARDIAN (IF YOU ARE A MINOR) MUST READ AND AGREE TO THE TERMS AND CONDITIONS OF THIS SUPERBEAST PRODUCT LIABILITY WAIVER PRIOR TO PURCHASING OR RIDING ANY SUPERBEAST® BRANDED ELECTRIC SKATEBOARD PRODUCT(S), INCLUDING PLACING ANY ORDER FOR ANY ELECTRIC SKATEBOARD PRODUCT(S) FROM THIS WEBSITE.
LIABILITY AND INHERENT RISK WAIVER
Riding a skateboard, whether electric or otherwise, is an inherently dangerous activity that requires a high level of awareness and adherence to certain safety precautions to help mitigate risk of serious injury or death.
You should only ride or purchase SUPERBEAST® branded products if you are an experienced rider, understand the inherent risks involved, and agree that you totally & unequivocally waive all your rights against Superbeast LLC (SBLLC) and its affiliated entities by riding or purchasing any SUPERBEAST® branded products.
While SBLLC takes commercially reasonable efforts to make all SUPERBEAST® branded products as safe as reasonably possible, no equipment or device is immune from malfunction. Additionally, many accidents are caused by operator error or miscalculation. Accordingly, you understand and agree that you must always ride at a speed at which you are comfortable and that will allow you to take action to avoid injury in case something unexpected or unusual happens.
By purchasing or using any SUPERBEAST® branded product, you hereby agree to waive all rights and forever release and discharge SBLLC and its affiliates, associates, managers, members, agent, owner, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and or any other associated entity from any and all liabilities associated with any claims and causes of action of any nature whatsoever related to the owning, possessing, using, or operating of any SUPERBEAST® branded product.
This SUPERBEAST® Product Liability Waiver will be interpreted against your interests in the broadest way possible. Finally, you understand and agree that if you are ever injured during the use of our products, your right to sue SBLLC and seek compensation for injuries or damages may be significantly compromised. Accordingly, if you do not understand and agree to the terms and conditions of this SUPERBEAST® Product Liability Waiver, do not purchase or use any SUPERBEAST® branded product.
Furthermore, you accept that you and only you are responsible for informing yourself of and obeying all local and state laws for riding an electric skateboard in your area, understanding the basic knowledge to safely assemble and maintain the electric skateboard, and also that you and only you are accountable for the physical integrity, maintenance and safety ASSESSMENT of the lithium ion battery inside the electric skateboard.
The terms and conditions of this SUPERBEAST® Product Liability Waiver may be limited in certain jurisdictions and your rights may be affected, depending on where you live.
